Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using any services provided by Fortify Chargebacks ("Fortify," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the platform.
2. Description of Services
Fortify Chargebacks provides chargeback representment preparation services, including but not limited to:
- Chargeback dispute report preparation and evidence assembly
- Fraud and risk pattern analysis
- Evidence and documentation strategy review
- Chargeback prevention consulting and guidance
- Processor compliance guidance (Visa VDMP, Mastercard ECM)
Important: Fortify prepares processor-ready dispute packages. We do not submit disputes on your behalf, nor do we provide legal advice or legal representation. All submissions to processors, banks, or payment platforms are completed by the merchant or their authorized representative.
3. Account Registration & Responsibilities
To use our platform, you must:
- Be at least 18 years of age
- Provide accurate, current, and complete registration information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Promptly notify us of any unauthorized access
You may not create an account using false identity information, use another person's account without authorization, or share your login credentials with third parties.
4. Client Obligations
As a Client of Fortify Chargebacks, you agree to:
- Provide truthful, accurate, and complete information for all cases submitted
- Supply genuine evidence and documentation — fabricated or altered evidence will not be accepted
- Respond to requests for additional information in a timely manner
- Not use the platform for any fraudulent, illegal, or unethical purposes
- Not misrepresent the nature of any transaction or dispute
5. Confidentiality & Data Protection
We take data security seriously. All information you submit through our platform is treated as strictly confidential.
- All data is encrypted in transit and at rest using industry-standard protocols
- Client data is stored securely on Google Firebase infrastructure
- We will not sell, share, or disclose your information to third parties unless required by law
- Access to your case data is restricted to authorized Fortify personnel only
6. Intellectual Property
All dispute reports, analysis documents, and representment packages prepared by Fortify are proprietary work products. Upon completion and delivery:
- You receive a license to use the deliverables for their intended dispute resolution purpose
- You may not redistribute, resell, or publicly share Fortify's work products
- Fortify retains intellectual property rights over its methodologies and frameworks
7. No Guarantee of Outcome
Fortify Chargebacks does not guarantee any specific outcome for any case. Chargeback dispute outcomes are ultimately determined by the issuing bank, card network, or payment processor. While we apply industry best practices and structured intelligence to maximize your chances, results depend on multiple factors outside our control, including but not limited to evidence quality, reason code, processor policies, and issuer decisions.
8. Fees & Payment
Fees for services are communicated to you prior to case engagement. By submitting a case, you agree to the fee structure as presented. Payment terms, refund policies, and billing procedures will be disclosed at the time of engagement.
9. Limitation of Liability
To the maximum extent permitted by law:
- Fortify shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform
- Our total liability shall not exceed the fees paid by you for the specific case in question
- We are not liable for losses resulting from case outcomes, processor decisions, or delays caused by third parties
10. Account Termination
Fortify reserves the right to suspend or terminate your account at any time if:
- You violate these Terms of Service
- You provide false or misleading information
- You use the platform for fraudulent or illegal purposes
- You engage in abusive or threatening behavior toward Fortify staff

11. Modifications to Terms
We reserve the right to update these Terms of Service at any time. Material changes will be communicated via email or platform notification. Continued use of the platform after changes constitutes acceptance of the revised terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through good-faith negotiation before pursuing formal legal proceedings.

Service Agreement
Applicable to each case submitted through the Fortify Chargebacks platform.
1. Scope of Engagement
By submitting a case through the Fortify Chargebacks platform, you ("Client") engage Fortify Chargebacks ("Fortify") to prepare a chargeback representment report for the submitted transaction dispute. This engagement covers:
- Review and analysis of the submitted dispute details and evidence
- Identification of evidence gaps and strategic recommendations
- Preparation of a structured, processor-ready dispute package
- Delivery of the completed report via the Fortify platform
2. Client Representations
By submitting a case, you represent and warrant that:
- All information provided is truthful, accurate, and complete
- All evidence submitted is genuine and unaltered
- You are the merchant of record or an authorized representative with authority to dispute the chargeback
- The transaction in question was conducted in good faith and in compliance with applicable laws
3. Fortify's Obligations
Fortify agrees to:
- Review each case with professional diligence and industry expertise
- Prepare dispute packages tailored to the specific reason code and network requirements
- Maintain strict confidentiality of all case data and evidence
- Communicate clearly about any additional information required from the Client
4. Disclaimer & Limitations
Fortify does not guarantee reversal of any chargeback. Our services are limited to professional report preparation and strategic guidance. We do not:
- Submit disputes to processors or banks on your behalf
- Provide legal advice or act as legal counsel
- Guarantee any specific financial outcome or recovery amount
- Accept liability for decisions made by issuing banks or card networks
5. Confidentiality
All case information, evidence, and deliverables are treated as confidential. Fortify will not share your data with third parties except as required by law or with your explicit written consent.
6. Acceptance
By checking the "I agree to the Service Agreement" checkbox during case submission, you acknowledge that you have read, understood, and agree to be bound by all terms in this Service Agreement and the accompanying Terms of Service.
